Initialement conçue pour conseiller la Commission et une commission chargée dans chaque Etat membre de délivrer une autorisation de mise sur le marché d'un produit pharmaceutique, l'Agence européenne des médicaments, organe supranational de régulation, domine, dans la pratique, la prise de décision et agit plutôt comme une agence indépendante. Une surveillance stricte apparaît compatible avec cette indépendance, le mécanisme de contrôle à plusieurs niveaux réduisant davantage l'influence des acteurs non scientifiques impliqués dans l'autorisation des médicaments que celle de l'Agence, dans la mesure où l'Agence respecte son mandat consistant à formuler des décisions scientifiquement convaincantes.
