L'arrêt rendu par la Cour de justice le 28 avril 1998 a relancé le débat sur les conditions dans lesquelles les ressortissants communautaires ont accès à la couverture maladie dans tous les pays de l'Union. A la question de savoir si le fait que le remboursement des frais médicaux soit subordonné à une autorisation préalable de l'organe d'assurance compétent est compatible avec l'art. 30 du Traité sur la libre circulation, la Cour a répondu que non, mais admis certaines justifications à l'autorisation préalable.
